TERMS AND CONDITIONS OF THE ONLINE STORE www.k-system.pro
dated 13 February 2016

I. Definitions

The terms used in these Terms and Conditions shall mean:

Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended)
Terms and Conditions – these Terms and Conditions for the provision of electronic services within the online store www.k-system.pro
Online Store www.k-system.pro – an online service available at http://www.k-system.pro/, through which the Customer may, in particular, place Orders
Goods – products presented in the Online Store
Sales Agreement – a sales agreement for Goods within the meaning of the Civil Code, concluded between K-SYSTEM and the Customer via the Online Store
Act on the Provision of Electronic Services – the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended)
Order – a declaration of intent made by the Customer aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods

II. General Provisions

  1. These Terms and Conditions define the rules for using the online store available at http://www.k-system.pro/.
  2. These Terms and Conditions constitute the regulations referred to in Article 8 of the Act on the Provision of Electronic Services.
  3. The online store operating at http://www.k-system.pro/ is run by K-SYSTEM Piotr Koniuszewski, ul. Saturna 11A/4, 83-010 Straszyn, Poland, VAT ID: PL9571016111, REGON: 361417559, registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the minister competent for economic affairs.
  4. The store sells NEW automotive parts and accessories. These parts do not have road-use approval and therefore must not be used on public roads, but exclusively in motorsport conditions (e.g. closed rally stages, race tracks). The store bears no responsibility for the use of products in violation of these rules and/or for issues related to comfort, increased noise or vibration resulting from product characteristics and/or normal operational wear. Product liability does not apply in such cases. The Customer/User is obliged to periodically and regularly inspect and maintain all purchased products in accordance with proper use standards for such components.
  5. These Terms and Conditions specify in particular:
    • rules for registration and use of an account within the Online Store;
    • terms and conditions for electronic reservation of products available in the Online Store;
    • terms and conditions for placing Orders electronically;
    • rules for concluding Sales Agreements using services provided by the Online Store.

III. Rules for Using the Online Store

  1. Registration is required to begin using the Online Store.
  2. Registration takes place by completing and accepting the registration form available on one of the Store’s pages.
  3. Registration requires acceptance of these Terms and Conditions and provision of mandatory personal data.
  4. K-SYSTEM may deprive the Customer of the right to use the Online Store or limit access to part or all of its resources with immediate effect if the Customer violates these Terms and Conditions, in particular if the Customer:
    • provided false, inaccurate or outdated data during registration;
    • violated the personal rights of third parties via the Online Store;
    • engaged in other actions deemed by K-SYSTEM to be contrary to applicable law, general Internet usage rules, or damaging to K-SYSTEM’s reputation.
  5. A person deprived of the right to use the Online Store may not re-register without prior consent from K-SYSTEM.
  6. To ensure the security of data transmission, the Online Store applies technical and organizational measures appropriate to the level of risk, including measures preventing unauthorized access or modification of personal data transmitted online.
  7. The Customer is obliged in particular to:
    • refrain from providing unlawful content, including content promoting violence, defamation or violation of personal rights;
    • use the Online Store in a manner that does not disrupt its operation;
    • refrain from activities such as sending or posting unsolicited commercial information (spam);
    • use the Online Store in a manner that is not burdensome to other customers or K-SYSTEM;
    • use content available in the Online Store solely for personal use;
    • comply with Polish law, these Terms and Conditions, and general Internet usage principles.

IV. Procedure for Concluding a Sales Agreement

  1. To conclude a Sales Agreement, the Customer must visit http://www.k-system.pro/, select Goods, and follow the on-screen instructions.
  2. Goods are selected by adding them to the shopping cart.
  3. Until clicking “Place Order,” the Customer may modify entered data and selected Goods.
  4. After providing all required data, an order summary will be displayed, including:
    • subject of the order;
    • unit and total price, including delivery and additional costs (if any);
    • selected payment method;
    • selected delivery method;
    • delivery time.
  5. Placing an Order requires acceptance of these Terms and Conditions, provision of mandatory data, and clicking “Place Order.”
  6. Placing an Order constitutes a declaration of intent to conclude a Sales Agreement with K-SYSTEM.
  7. After placing an Order, the Customer receives two emails:
    • “Order Receipt Confirmation” (automatic, not constituting acceptance);
    • “Order Fulfillment Confirmation” (final confirmation of all essential elements).
  8. The Sales Agreement is deemed concluded upon receipt of both emails.
  9. The Sales Agreement is concluded in Polish, in accordance with these Terms and Conditions.
  10. All product information, catalogs, brochures, and advertising materials do not constitute an offer under applicable law but only an invitation to negotiate.

V. Delivery

  1. Orders are delivered throughout Poland and to selected European countries and worldwide upon request.
  2. Domestic delivery in Poland is carried out by courier service.
  3. Delivery costs:
    • Courier delivery – €7 gross.
  4. International shipping costs are determined individually. Payments from outside Poland are accepted via PayPal or bank transfer in EUR. Shipments are handled by GLS, DPD, or UPS.
  5. Delivery time ranges from 1 to 20 business days from Order placement.
  6. These Terms and Conditions are available at any time via the website and may be downloaded and printed.

VI. Prices and Payment Methods

  1. Prices are given in EUR and include VAT.
  2. Customers outside Poland may pay via PayPal or bank transfer in EUR.

VII. Right of Withdrawal

Customers have the right to withdraw from the contract within 14 days without stating a reason.

VIII. Warranty (Statutory Warranty)

IX. Final Provisions

  1. Disputes involving consumers shall be resolved by courts competent under the Polish Code of Civil Procedure.
  2. Disputes involving non-consumers shall be resolved by the court having jurisdiction over K-SYSTEM’s registered office.
  3. Matters not regulated herein are governed by the Polish Civil Code, the Act on the Provision of Electronic Services, and other applicable Polish laws.
